Introduction

Pearlie Arts ("we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us through the Pearlie Arts mobile application ("App") and related services. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the App.

Information We Collect

Information You Provide Directly

  • Account Information: Full name, email address, date of birth, and password when you create an account.
  • Profile Information: Optional profile details you choose to provide.
  • Transaction Information: Purchase history, shipping addresses, and payment details processed through secure third-party payment processors (Apple App Store, Google Play Store, and Stripe).
  • Curated Access Participation: Entry records, selection status, and skill-testing question responses (Quebec residents).
  • Communications: Messages you send to us through support channels.
  • Live Streaming & Chat Data: When you participate in Pearlie Sessions, we collect chat messages, emoji reactions, tip amounts, poll responses, and other interactions you submit during live sessions. Chat messages are transmitted in real time through our third-party messaging provider (Ably) and are visible to other session participants.
  • Creator Data: If you are invited to become a Pearlie Creator, we collect your display name, contact email, biography, profile image, banner image, host type (artist, winery, chef, collector, etc.), invitation token, agreement signing date, commission rate, and linked Pearlie Arts account details. This information is used to manage your creator profile, schedule sessions, and process session revenue.
  • In-App Broadcasting: If you use the in-app live broadcasting feature, we request access to your device camera and microphone. Camera and microphone data is streamed in real time to our video provider (Mux) and is not stored locally on your device beyond the duration of the broadcast.

Information Collected Automatically

  • Usage Data: App interactions, screens viewed, features used, and session duration.
  • Device Information: Device type, operating system, unique device identifiers, and push notification tokens.
  • Session Preference Data: Session reminder preferences (which sessions you have bookmarked for reminder notifications) are stored to deliver timely push notifications when a session goes live.
  • Location Data: General geographic region (country/state level) for content localization. We do not collect precise GPS location without explicit consent.
  • Log Data: IP address, error logs, and crash reports.

Information from Third Parties

  • Apple/Google: Subscription status, receipt verification data, and in-app purchase information.
  • Stripe: Payment confirmation data (we do not store full card numbers).
  • Mux: Video streaming analytics, playback quality metrics, and recording metadata for Pearlie Sessions.
  • Ably: Real-time messaging tokens and connection metadata for Pearlie Sessions chat.
  • Expo Push Notifications: Push notification delivery tokens and delivery status.

How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the App and its features
  • Process payments, subscriptions, and physical product orders
  • Manage Curated Access entries and selections
  • Deliver Pearlie Sessions live streams, chat, and interactive features
  • Send session reminder push notifications when a followed session goes live
  • Manage creator profiles, session scheduling, and commission reporting
  • Provide customer support and respond to inquiries
  • Send transactional notifications (order confirmations, shipping updates, session reminders)
  • Ensure compliance with legal obligations and our Terms of Service
  • Detect, prevent, and address fraud, abuse, and security issues
  • Analyze usage patterns to improve user experience

How We Share Your Information

We do not sell your personal information. We share information with:

  • Service Providers: Third-party vendors who help us operate the App (Mux for video, Ably for chat, Stripe for payments, Expo for push notifications, Neon for database hosting).
  • Legal Requirements: When required by law, court order, or governmental authority.
  • Business Transfers: In connection with a merger, acquisition, or sale of assets.
  • With Your Consent: In other circumstances with your explicit consent.

Creator profiles (display name, bio, host type, profile image) are publicly visible to all app users. Creator contact email and commission rate are visible only to Pearlie Arts administrators.

Data Retention

  • Account Data: Retained while your account is active and for a reasonable period thereafter.
  • Transaction Records: Retained as required by applicable law and tax regulations.
  • Chat Data: Session chat messages are retained for a limited period for moderation purposes.
  • Session Reminders: Reminder preferences are retained until you remove the reminder or the session concludes.
  • Creator Data: Retained for the duration of the creator relationship and as required by applicable law.
  • Streaming Data: Live session recordings and analytics are retained per our agreement with Mux.

Your Rights and Choices

Depending on your jurisdiction, you may have rights including:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate information.
  • Deletion: Request deletion of your personal information. You may delete your account at any time through Settings > Privacy & Data > Delete Account.
  • Opt-Out: Opt out of marketing communications at any time.
  • Push Notifications: Manage notification preferences in your device settings or within the App.
  • Session Reminders: Remove any session reminder at any time by tapping the bell icon (🔕) on the session card.
  • Camera & Microphone: Revoke camera and microphone permissions at any time through your device settings. Revoking these permissions will disable in-app broadcasting functionality.

California Residents (CCPA/CPRA)

California residents have additional rights under the CCPA/CPRA. We do not sell or share your personal information for cross-context behavioral advertising. For California-specific requests, contact privacy@pearliearts.com.

Canadian Residents (PIPEDA / Quebec Law 25)

Canadian residents have rights under PIPEDA and applicable provincial privacy laws. Quebec residents may request their data in a portable format and have additional rights under Law 25. For requests, contact privacy@pearliearts.com.

Children's Privacy

The App is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will promptly delete it. If you believe a child under 13 has provided personal information, please contact us at privacy@pearliearts.com.

Security

We implement industry-standard security measures including encryption in transit (TLS/HTTPS), secure storage, and access controls. Payment data is handled exclusively by PCI-compliant processors (Apple, Google, Stripe) and is never stored on our servers. Live streaming video is transmitted over encrypted channels via Mux.

International Data Transfers

Your information may be transferred to and maintained on servers located outside your province, state, or country. By using the App, you consent to such transfers in accordance with this Privacy Policy. Live streaming and chat services may process data through servers in multiple regions to ensure optimal performance.

Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated policy.
